Your lawyer will guide you through the process of the sales contract and any other issues that arise during the process. The contract will basically state that you or no other has a charge on the property and that you are the legal owner of the property, the contract will also state the deposit paid and the amount of the outstanding sale price to be paid.
Your lawyer will also explain to you some details not expressed specifically in the contract.
Documentation
It will save considerable time if you have all the documentation available for inspection by the purchaser lawyer:
Escritura: This is the title deed to your property, it confirms that you are the registered owner, it also shows all charges or liens against the property. If you do not have a copy of your Escritura you may obtain a copy from the Notario where you signed for the property when you purchased it.
IBI receipt:
This is your receipt for the paid-up Impuesto sobre Bienes Inmuebles, the Real Estate Tax. The IBI receipt shows first that the estate tax is paid up for this year.
Community charges and statutes
If your property is part of a community and there is a charge then you will need to present a receipt showing the fees paid for the year to date. You will also need a copy of the community statutes which regulate your community.
Utility bills
Copies of your bills for rubbish, water, electricity and even telephone are now required by prospective purchaser to show all bills are fully paid up and to work out annual costs.
Once collated it is a good idea to make photocopies of these documents for distribution.
